Due to globalisation, effective Intellectual Property management is becoming increasingly important for businesses around the world. The “patent thicket” strategy adopted by multinational companies is often costly and difficult to enforce, hence not necessarily viable for start-ups. Yet, young companies must leverage their IP portfolio as a competitive advantage, especially in this post-recessionary world. What creative and pragmatic approaches can they take?

  • Brand protection through trademark and design rights
  • New forms of IP such as patent pooling, creative commons, open innovation
  • Harmonised patent protection
  • Managing patents as an asset class
